Distance Sales Agreement

1. Parties

This Agreement is entered into between:

Buyer: The customer booking the services via the website.

2. Definitions

Definitions in this agreement are used in accordance with Law No. 6502 on the Protection of Consumers and the Regulation on Distance Contracts.

3. Subject

The subject of this agreement is the determination of the rights and obligations of the parties in relation to the sale and delivery of travel and tour services booked by the Buyer electronically from the website of the Seller.

4. Service Information and Prices

The type, quantity, sale price, and payment method of the services are as stated on the website at the time of booking. All prices include applicable taxes. Shore excursions and Cappadocia tours that start at the Buyer’s hotel are paid in cash on the tour day (no deposit): shore excursions in US dollars, euros or British pounds, Cappadocia tours in euros or US dollars, in the amounts stated in the booking confirmation. For other tours and packages a deposit of 40% of the total (for trips with domestic flights, at least the flight cost) is paid by card online when the booking is made; the balance is paid in cash on arrival, with a discount of 5% of the total. Payment on the tour day is cash only; card payment, once offered, is online only. Cancellations and changes follow the Seller’s Cancellation & Refund Policy for the type of trip, as shown before booking.

5. Right of Withdrawal

IMPORTANT NOTICE REGARDING WITHDRAWAL:

In accordance with Article 15 of the Regulation on Distance Contracts, the right of withdrawal does NOT apply to contracts related to the use of free time for accommodation, transport of goods, car rental, food and beverage supply, and travel/leisure activities which must be carried out on a specific date or period.

Therefore, bookings for specific tour packages, daily tours, hotel stays, and transfers made through TurkeyVia are generally excluded from the 14-day statutory right of withdrawal once confirmed.

6. Default

Where a payment is made online by credit card and the Buyer defaults on it, the Buyer shall pay interest and be liable to the bank within the framework of the credit card agreement between the cardholder bank and the Buyer.

7. Competent Court

In the implementation of this agreement, Consumer Arbitration Committees and Consumer Courts in the place where the Buyer purchased the services or where their residence is located are authorized up to the value declared by the Ministry of Trade.

8. Enforcement

The Buyer accepts the terms of this agreement by ticking the consent box when sending the booking request. The agreement is concluded when the Seller confirms the booking (tours paid on the tour day) or when the deposit is received (other tours and packages).
